ICC Demands NTC Hand Over Saif Gaddafi

Please read the following ICC statement.

PRE-TRIAL CHAMBER I

On 6th December 2011, the Pre-Trial Chamber I sought from Libyan authorities, on an urgent basis, information on the following issues:

(i)               Whether Saif Al-Islam Gaddafi was arrested on account of the Court’s warrant of arrest;

(ii) Whether the information received by the Chamber as to Saif Al-Islam Gaddafi being held incommunicado is true;

(iii) When and where the Registrar, or one of her representatives, could meet Saif Al-Islam Gaddafi in order to seek his views on being assigned counsel from the Court for purposes of proceedings before the Court;

(iv)           How, when and where could an expert be mandated by the Court to examine Saif Al-Islam Gaddafi in order to assess his physical and mental state and;

(v)             Whether and when the Libyan authorities intend to surrender Saif Al-Islam Gaddafi to the Court.

The Pre-Trial Chamber requested the Libyan authorities to file submissions on the issues specified above by Tuesday, 10 January 2012 and on 9th December 2011 the Registry served a request for cooperation on the competent Libyan authorities in accordance with the issues raised above.

On 9th January 2012 the Registry transmitted to the Pre-Trial Chamber, a letter received from the Libyan authorities expressing their request for an extension of the time limit to submit their observations regarding the arrest of Saif al-Islam Gaddafi. The letter indicated that due to the security situation in Libya, the Libyan authorities were not able to meet the deadline of 10 January 2012. The Libyan authorities requested the Pre-Trial Chamber to grant an extension of time of 3 weeks from 10 January 2012.

On 10th January 2012, the Pre-Trial Chamber I made a decision on the January 9th request by the Libyan authorities for an extension of time limit to submit observations. The Pre-Trial Chamber held that given the prevailing political and security situation in Libya, good cause was shown to necessitate the extension of the time limit to submit observations. However, the Pre-Trial Chamber considered that the length of the extension requested would cause an undue delay in the proceedings and that therefore only a shorter extension would be appropriate.

Therefore, the Pre-Trial Chamber granted the request for an extension of time to the Libyan authorities and held that observations regarding the arrest of Saif Al-Islam Gaddafi must be filed by 16:00 on Monday, 23 January 2012.

Saif remains isolated without medical treatment for his hand and without access to legal counsel. The Libyan authorities have not charged him with any crime.

We have not been able to obtain proof of life.

I ask readers to take action and demand that Saif is granted immediate access to a legal counsel of his choice who can negotiate his release. Without intervention he will have no chance of a fair trial with either the ICC or the NTC.  He will most likely be executed before either would take place.

With legal counsel there is hope his situation can be resolved outside of the courts and his life spared.

However that counsel MUST NOT be an ICC appointment operating on behalf of NATO!

Saif should not have to stand trial. He is a political leader, not a criminal.
