Saif al-Islam Gaddafi appeared in court on Thursday in the town of Zintan.
He has been at the center of a legal battle between Libya and the International Criminal Court since his capture in November, 2011.
John Jones, recently appointed by the ICC as Saif Gaddafi’s defense counsel, stated that the documents Zintan claim constitute a “national security threat”, were nothing more than Saif expressing a preference to be tried by the ICC and that the national security charges Saif al-Islam faced were “the antithesis of justice”. Libyan authorities violated his right to speak to a defense lawyer by seizing the documents and detaining his original legal counsel, Melinda Taylor.

Saif has NOT agreed to be represented by the Zintan court appointed lawyers.

تأجيل محاكمة سيف الإسلام القذافي إلى 19 سبتمبر/أيلول المقبل

قال مسؤول في مجلس محلي إن سيف الإسلام نجل العقيد معمر القذافي مثل أمام محكمة ببلدة الزنتان الليبية يوم الخميس. وكانت ميليشيا تحتجز سيف الإسلام في الزنتان منذ إلقاء القبض عليه في نوفمبر/تشرين الثاني عام 2011 .
وذكرت وكالة “رويترز” يوم الخميس 2 مايو/أيار، أن سيف الإسلام ظهر في المحكمة مبتسما وقال للصحفيين إنه بصحة جيدة.
وقررت المحكمة تأجيل محاكمة سيف الإسلام القذافي إلى 19 سبتمبر/أيلول المقبل.
يذكر أن سيف الإسلام مطلوب أمام المحكمة الجنائية الدولية لاتهامه بارتكاب جرائم حرب، لكن مثوله أمام المحكمة يوم الخميس يتعلق باتهامه بنقل معلومات يمكن أن تعرض الأمن القومي الليبي للخطر إلى محامية في المحكمة الجنائية الدولية العام الماضي.
وكانت المحامية الأسترالية ميليندا تيلور نفسها قد احتجزت لمدة ثلاثة أسابيع بعد لقائها بسيف الإسلام. وتقول المحامية منذ ذلك الحين إن احتجازها يثبت أن سيف الإسلام لا يمكن أن يحظى بمحاكمة عادلة في ليبيا وإنه يجب أن يحاكم في لاهاي مقر المحكمة الجنائية الدولية.
وتريد ليبيا محاكمة سيف الإسلام أمام قضائها، لكنها لم توجه له حتى الآن اتهامات بارتكاب جرائم حرب، وقال المدعي العام الليبي إن هناك قضية تعد حاليا وإنها ستحال إلى المحكمة قريبا.

مثل سيف الاسلام اليوم الخميس امام محكمة الزنتان بتهمة “الاساءة الى الامن القومي”
وظهر سيف الاسلام بلباس المعتقلين الازرق، في قفص الاتهام وراء قضبان حديدية، والى جانبه اثنين من رجال الشرطة ملثمين.
طلب الدفاع الذي اعرب عن الامل في الحصول على كامل الملف.
وتمكن الصحافيون من تبادل الكلام لفترة وجيزة مع المتهم الذي اجاب بالايجاب على سؤال يتعلق بمعرفة ما اذا كان في حال جيدة، مضيفا الى ذلك اشارة من ابهامه تؤكد ذلك.
وفي مؤتمر صحافي بعد المحاكمة، اعلن محمد العلاقي رئيس المجلس الوطني للحريات وحقوق الانسان ان “سيف الاسلام محتجز في ظروف تتوافق والقواعد الدولية”.
وردا على سؤال للقاضي عما اذا كان يقبل بالمحامين الليبيين اللذين تم تعيينهما للدفاع عنه، احجم المتهم عن الاجابة. وعندما طلب منه القاضي ان كان لديه مطالب، اجاب سيف الاسلام بالنفي.
واستدعى القاضي الاعضاء الاربعة في المحكمة الجنائية الدولية المتهمين مع سيف الاسلام القذافي في هذه القضية، لكنهم لم يكونوا حاضرين داخل قاعة المحكمة

Saif al-Islam Gaddafi has appeared in court accused of plotting to escape from the jail in which he has been held since he was arrested in November 2011.
Libya accuses Gaddafi of conspiring to break out of his detention, in the western mountain town of Zintan, aided by a lawyer from the international criminal court (ICC), Melinda Taylor, who was herself detained by Libya for three weeks last summer.
It was only the second appearance in court by Gaddafi, 40, since he was captured trying to flee Libya by former rebels.
The case is separate from charges of war crimes and crimes against humanity he faces from both Libya and the ICC, but Thursday’s 20-minute hearing was branded a farce by his British lawyer, John Jones QC.
“It’s a farce from start to finish,” said Jones, who was not in court. “His detention is Libya’s Guantánamo Bay. He’s been held incommunicado for 17 months without any meaningful judicial process.”
The court appointed two local lawyers to represent him, adjourning the case until September.
Libya alleges that Taylor had the items with her during a meeting in June last year. Prosecutors say they formed part of a conspiracy to organise an escape.
Thursday’s hearing throws fuel on the fire of a simmering row between Libya and the ICC over who should try Gaddafi, with the court in The Hague demanding he be handed over to their custody.
