US Obtains Immunity From Prosecution For Non-Members Of The ICC For War Crimes In Libya

U.S. sponsored terrorism in Libya is in direct contravention to International Law.

On Februrary 26, 2011, the U.N. Security council passed Resolution 1970.

Fearing ICC prosecution resulting from disclosures of their own terrorist activities within Libya, not to mention other dangerous, incriminating revelations that would inevitably arise should Muammar Gaddafi testify at The Hague, the United States forced the United Nations to include the following clause:

6. […]nationals, current or former officials or personnel from a State outside the Libyan Arab Jamahiriya which is not a party to the Rome Statute of the International Criminal Court shall be subject to the exclusive jurisdiction of that State for all alleged acts or omissions arising out of or related to operations in the Libyan Arab Jamahiriya established or authorized by the Council, unless such exclusive jurisdiction has been expressly waived by the State.

Mainstream media were quick to spin this into; “African mercenaries ‘are immune from prosecution for war crimes'”.

This was not a benevolent gesture. The U.S. is shielding only itself and those operating on its behalf.

The US is not a state party to the Rome Statutes of the ICC.

In essence, clause 6 provides immunity to the United States for its covert criminal engagement in funding, arming and training terrorist organizations and the CIA supported “Libyan opposition” assigned to overthrow Muammar Gaddafi, as well as immunity from crimes it is about to commit during imminent military intervention to complete the covert objectives.

Global citizens of conscience must be aware of the implications of this resolution and specifically clause 6.

When Israel conducted its odious 28 day criminal assault on innocent civilians in Gaza, where was the United Nations? The U.S. and NATO? Where was the moral outrage? And the U.N. resolutions to intervene and bring Israel to The Hague?

There is more than hypocrisy here. It is evident that the United Nations has been subverted and supplanted by NATO and serves the imperialist colonial agenda.

Having successfully established another precedent that positions a rogue nation beyond the reach of International Law, immune to prosecution for crimes of terrorism, war crimes, crimes against peace and humanity,  I fear for the next victim nation on the CFR-Brookings-Freedom House hit list.
