من كثر الأهوال التى نعيشها و الظروف القاسية التى نمر به من قتل ، و مذابح و أغتصاب و أنتهاك حرمات المنازل و سرقة و تعذيب و تهجير و ملاحقة المهجرين فى داخل و خارج و ملاحقتهم فى اى مكان وطئت فيه أقدامهم ، و الصمت المخزى من قبل حكومات العالم و مؤسسات المجتمع المدنى و منظمات حقوق الإنسان ، و غض الأسماع و الأبصار من قبل القضاة و محاميين و سياسيين و دعاة الحرية و الديمقراطية .

لم نرى منهم شيء يذكر ، ما عاد بعض التصريحات التى تعد على أصابع اليد المنددة لتلك الأفعال الإجرامية ، وكل هذا يحصل أمام مرى و مسمع منظمات و هيئات حقوق الإنسان الذى من المفترض أن تقوم بعمله منوط لها أتجاه هؤلاء .

فأين منظمات و هيئات حقوق الإنسان مما يحصل الآن فى ليبيا و زج بها فى فوضى المتواصلة والمتعاظمة و خلق مناخ من الاستباحة الشاملة للأرواح البشرية و ممتلكات و مقدرات الدولة ونهب للمال العام و تغييب مبدأ المحاسبة والمساءلة ، و محاولة الغاء هوية الليبيين و طمس تاريخهم و تمكين الفساد الأخلاقى و غياب الواعز الدينى .

الى متى سيبقى الصمت هو سيد الموقف ؟؟؟

لليبيين يعانون أبشع أنواع الجرائم، التى فاقت جميع الجرائم التى حصلت على مر العصور ، شعب لا يتعدى تعداده 6 مليون تحصل لهم أبادة جماعية و بطرق مختلفة ، و الان نشاهد مطاردة جماعية الليبيين متواجدين فى مصر و تونس و مغرب و نيجر و غيرها من الدول الأخرى .

المهجريين يعانون الويلات لان تهجيرهم جاء قصرا و ليس رغبتنا منهم فى ذلك ،و وجدوا البلد المستضيف مأمنا بعد أن ضاقت بهم بلدهم الأم !!! نظرا لما عانوه و سيعانونه لو بقوا فى بلدهم من ظروف غاية في الصعوبة وسيواجهون سياسات قمعية ممنهجة تهدف إلي كسر إرادتهم وتحطيم معنوياتهم فى العيش كبشر على سطح الأرض ، بل وجدوا بأن الكرة الأرضية ضاقت بهم لأنهم أصبحوا مطاردين فى كل مكان و فى كل دولة و لم يجدوا حدود خارج حدود الكرة الأرضية لذهبوا لها ، حتى يعيشوا بأمان و سلام .

جميع الأتفاقيات الدولية قد نصت بشكل واضح على حق المهجر قصرا سواء كان بسبب الحروب أو أختلاف فى الآراء السياسية ، و أيضا للاجئين السياسيين حيث نصت جميعها بالتمتع للاجى و مهجر بجميع الحقوق والضمانات الأساسية وفقا لاتفاقية جنيف المتعلق بحماية ضحايا النزاعات المسلحة وضحايا الهجرة بسبب الحروب .

و من أبرز الحقوق التى ضمنتها الأتفاقيات الدولية فيما يتعلق بحقوق الإنسان أحترام حقه فى لجوء السياسى و أيضا حقه كمهجر و توفير جميع سبل الراحة له بما يضمن حقه كإنسان .

يجب النظر إلي مدى أنطباق هذه المعايير علي ظروف أعتقال المهجرين و لاجئين السياسيين فإن الغالبية العظمى من هذه النصوص غير معمول به على الإطلاق بالمقارنة مع طبيعة الممارسات والإجراءات المتبعة بحقهم من قبل من يعتلون سد الحكم فى بلد المستلم و بلد المضيف ، وهذا سيترك آثارا سلبية وخطيرة علي سياسات هذة الدول محليا و عربيا و عالميا ،

هل أصبحت اللوائح فى نصوص أتفاقيات حقوق الإنسان لا تشمل المحرومين و مشردين و معذبين و مقهورين و مستضعفين و مهجريين ، فى حين نجد هذة اللوائح قوة ضاربة بيد من حديد فى يد الأقوياء و أصحاب السلطة و الطبقة البرزواجية ، أذا مست حقوقهم حتى ولو بكلمة.

هل أصبحت حقوق الإنسان و منظمات لم تحمل إلا الأسم فقط * الإنسان * فى حين نجدها تحمى الحيوان من خطر الإنسان و أصبح الحيوان أجلكم الله يتمتع بكافه حقوقه .

لذا نناشد بعض المنظمات و الهيئات الإنسانية و الحقوقية و المدنية حكومية منها و غير حكومية و ناشطيها فى جمهورية مصر العربية للوقوف بجانب المهجرين و محافظة على حقوقهم و حماية إنسانيتهم

CAIRO — Libya’s transitional government is completing an agreement with Egypt to deposit $2 billion in the Egyptian central bank, an official briefed on the talks said Sunday.

The timing suggested a possible quid pro quo, coming five days after Egypt complied with a months-old Libyan request to round up for possible extradition at least three prominent loyalists of Col. Muammar el-Qaddafi’s who had been living openly in Cairo.

The $2 billion deposit was first reported by the Anatolia news agency of Turkey on Sunday, citing information from the Libyan ambassador to Cairo, Mohamed Fayez Jibril.

The Libyan government had pleaded for months for the extradition of dozens of former allies of Colonel Qaddafi’s who are wanted for trial in Tripoli. But Egypt appeared willing to allow them to remain at liberty in Cairo. It has become a gathering point for Qaddafi loyalists who fled the revolution in Libya.

Egypt, however, is now acutely short of hard currency. Tourism revenue and new foreign investment have collapsed during the tumult that has followed the ouster of President Hosni Mubarak two years ago.

Egypt’s reserves have fallen to less than $14 billion, from about $36 billion before the revolution, depressing the value of the Egyptian pound and raising questions about the government’s ability to import essential commodities like fuel and wheat. Egypt is in talks with the International Monetary Fund over a $4.8 billion loan package that could reassure other potential lenders about Egypt’s creditworthiness. But the negotiations have stalled over how much Egypt must raise taxes and cut subsidies.

The Libyan deposit is tantamount to an open-ended loan to Egypt. In similar arrangements, the depositor retained the right to withdraw the money, allowing Egypt to use it temporarily to pump up its currency supply.

Those arrested include Ahmed Qaddaf al-Dam, a cousin of Colonel Qaddafi’s; Ali Maria, the former Libyan ambassador to Cairo; and Mohamed Ibrahim, the brother of a Qaddafi spokesman, Moussa Ibrahim.

Citing an Egyptian security official, The Associated Press reported that the Libyan government had asked Egypt last year to arrest nearly 40 suspects, and that a delegation sent to Cairo on Thursday to arrange for extradition had brought a list of 88 more.

Mr. Dam is challenging his extradition on the ground that he holds an Egyptian passport because his mother was an Egyptian, from an area near the Libyan border, according to news reports. But he also faces Egyptian charges related to illegal weapons that the police say were discovered in his Cairo home.

تجمهر العشرات من السيدات الليبيات أمام بوابة محكمة النقض بدار القضاء العالي، اليوم الحميس، وذلك احتجاجًا علي ضبط قذاف الدم من قبل السلطات المصرية.

إلقاء القبض في القاهرة على أحمد قذاف الدم ابن عم العقيد معمر القذافي

سلم أحمد قذاف الدم، ابن عم الزعيم الليبي السابق العقيد معمر القذافي، نفسه إلى قوات الأمن المصري، التى حاصرت منزله بالقاهرة صباح الثلاثاء، وذلك بناء على أمر ضبطه وإحضاره، بحسب موقع “الأهرام”. يذكر أن قوات الأمن بالقاهرة حاصرت بالاشتراك مع الإنتربول والأمن العام منزل أحمد قذاف الدم بحي الزمالك في وسط العاصمة المصرية، نظرا لأنه مطلوب للإنتربول بسبب اتهامه فى عدد من قضايا النظام السابق في ليبيا، وقد حدثت مناوشات بينه وبين الأمن قبل أن قرر تسليم نفسه. من جهته قال المستشار كامل سمير مدير مكتب التعاون الدولي، إن الإنتربول المصري ألقى القبض على أحمد قذاف الدم على منسق العلاقات المصرية الليبية السابق، وعلي ماريا سفير ليبيا السابق في مصر وآخرين. وأضاف أن ضبطهم جاء بسبب اتهامهم بمخالفات مالية في ليبيا.

الذي حدث معي يوم 19مارس.. وهو بالمناسبة نفس الليلة، التي غزا فيها حلف «الناتو» العراق .. ونفس الليلة التي غزا فيها الحلف ليبيا.. وفيها داهم شقتي المتواضعة بعد منتصف الليل كتيبة من قوات خاصة من الملثمين ..عرفت أخيرا أنهم شرطة .. بعد أكثر من خمس ساعات.. من الرماية المستمرة.. علي كل شيء .. دون مراعاة لأي شيء .. ولولا حماية الله .. الذي كان أكبر من كل ظالم .. لوقعت مذبحة كبري تكتب في تاريخ مصر .. أن ما حدث معي يتنافى مع أبسط القواعد الأخلاقية والإنسانية والسياسية والعربية والإسلامية.. وأتوجه للسيد الرئيس محمد مرسي.. والذي حدث هذا في غيابه وأترك له الأمر .. لأنني في ضيافته.

وليعرف الجميع أن التهمة الموجهة لي عن طريق البوليس الدولي لا تتطلب كل ذلك.. فهي ذات شقين، الأول هو الاستحواذ على الشركة الزراعية والمطالبة باسترجاعها وهي بالمناسبة في مصر بطريق الإسماعيلية.. وليعلم أهلنا في ليبيا، منذ أن تسلمت الحكم في ليبيا وهي ملك الاستثمارات الليبية .. ولا علاقة لي بها وهذا موثق .. وقد قدم السادة المحامون كل الوثائق اللازمة ..وذكرت ذلك في التحقيق، والتهمة الثانية هي تزوير جواز سفر ياسم كودي في شهر 5/2011، ما يعد افتراء واضحًا ..فأنا منذ 20فبراير 2011.. وأنا مقيم في القاهرة ..فكيف لي أن أزور .. علما بأنهم ادعوا بأنه صادر من طرابلس .. وبأمر من السلطات ..في ذلك الوقت .. وهذا كل ما لديهم !!!

إن الموضوع برمته هو كيدي لغرض سياسي بحت .. وما تم معي لا يبرر كل ما تم .. وأتحدى حكومة طرابلس أن تقدم أي وثيقة إدانة أو تهمة، وأطلب من الإخوة المحامين نشر الوثائق ليعرف الليبيين والشعب المصري والعالم هذا الزيف، وسأحتفظ بحقي في مقاضاة حكومة طرابلس أمام المحافل الدولية لما لحق بي من ضرر .. لا يفوتني أن أحيي المئات من الرجال والنساء الذين تدفقوا من كل مكان طوال الليل للدفاع عني عندما اعتقدوا أن هؤلاء المهاجمين بلطجية أو عصابة وأطلب من الجميع ضبط الأعصاب كما أنني أعتذر لكل سكان العمارة عن هذه المعركة داخل سكناهم وإزعاجهم وأطفالهم طوال الليل، بعد أن عاشوا في رعب، وهم يعرفونني جيداً وسيقبلون عذري.

ومرة أخري خلال شهر أجد نفسي مضطراً لأن أطمئن 850 ألف لاجئ ليبي استجاروا بمصر، بأن مصر لن تغدر بهم، وما حدث معي لا يعبر عنها، فهذا قدرنا وقدرها .. وأدعوهم لضبط النفس، أخيراً أطمئن الجميع أنني بخير ومعنوياتي عالية.. وبمناسبة عيد الأم، أسامح مصر أولا وكل من أساء لي، وأخيراً أشكر المئات من المحامين الذين تطوعوا للدفاع عني وكذلك المنظمات التابعة لحقوق الإنسان.

Government forces stationed at Bir Dufan have been accused of using gas on civilians from Bani Walid during an attack that took place on Monday.

Following two visits to the town, the Libya Herald learned that 26 patients had been admitted to hospital with symptoms including hallucinations, foaming at the mouth, muscle spasms, coughing, eye irritations, dizziness, breathing difficulties and loss of consciousness.

A further 30 people were wounded following bombardments that took place on Sunday and Monday, in which Grad rockets and tanks were allegedly used. Three of the patients remain in a serious condition, including a 12-year old boy and his 16-year old sister, who are suffering from severe burns.

The attacks were primarily focused on the Mordum area, some 20 kilometres northeast of Bani Walid, although a few buildings were hit in the town itself.

Clashes also took place in Mordum on 2 October, shortly after government forces took up positions at four separate locations surrounding Bani Walid. One man was killed, named locally as Muammar Dammi, whilst several others were injured.

“We started receiving patients with strange symptoms that I have not seen before”, said Taha Mohammed, a doctor at Bani Walid hospital, in reference to Monday’s attack.

“Those affected were having difficulty breathing, reported dizziness and were coughing. Not everybody displayed the same symptoms, but some were also suffering from hallucinations, foaming at the mouth and loss of consciousness. We believe they had been exposed to some sort of gas”.

Mohammed said he had been unable to identify precisely what kind of gas, if any, was used, as the hospital did not possess the necessary equipment.

A doctor’s note from the hospital dated 8 October listed a number of the aforementioned symptoms, adding that “the response of those patients to routine medical treatments was slow and incomplete, which makes the inhalation of toxic gas a very strong possibility. All of them are very well and healthy individuals with no history of heart or lung diseases before this occasion.”

“I heard an explosion, my eyes became irritated and my mouth dried up”, said Ramadan Sahad Ramadan, one of the patients said to have been exposed to the gas, who also showed signs of breathing problems.

“I saw many tanks, I heard a big explosion and then I woke up in the hospital”, said Abubaker Sudani, another patient, who had no external injuries resulting from the blast. “I have difficulty breathing, I cannot see properly and I have thrown-up”.

Responding to the allegations, Colonel Ali Sheikhi, a spokesman for Chief of Staff General Yusuf Mangoush, denied that any gas had been deployed against the town.

“No gas has been used against Bani Walid”, he said. “We do not possess any such weapon”.

Sheikhi stated, however, that Mangoush had not authorised the recent actions against Bani Walid, effectively conceding that the forces at Bir Dufan had acted unilaterally.

One soldier stationed at Bir Dufan confirmed that an attack had taken place but also denied that any gas was used.

“We don’t have any gas”, said the Misratan, who requested to remain anonymous. “We don’t have that and we wouldn’t use that against civilians.

“You saw what we had with your own eyes when you came. We have some Grads up front, a few tanks, and the vehicles [flat-bed pick-up trucks fitted with machine guns and mounted rocket launchers].”

The soldier said that their forces had also come under attack from Bani Walid, but could not verify which side had fired first.

“It happened at around 9am on Sunday, said Zaynab Hamid, the sister of the two children. “We heard the sound of guns, and as soon as we tried to hide, the shell hit the house.”

Hamid, whose family are refugees from Tawergha, said that she believed the blast was caused by a Grad rocket, but could not be certain if that was the weapon used. Her mother was also lightly injured in the explosion.

To date it is only forces from the Bir Dufan camp, the majority of whom hail from Misrata, that have been engaged in clashes with Bani Walid.

On Sunday, forces on the road from Tarhuna withdrew altogether, reportedly after commanders decided they wished to play no further part in the siege.

The two remaining camps, on the road from Sirte to the east and from the Nafusa Mountains to the south, are said to still be in place but have not attempted to engage with Bani Walid as yet.

The catalyst for the current standoff was the death of Omran Shaban, the Misratan revolutionary credited with first discovering Muammar Qaddafi last October, who died in a hospital in Paris on 25 September.

Together with a colleague, he was captured in Bani Walid in July and held for two months before being released on 13 September following mediation efforts led by National Congress President Mohamed Magarief.

It is known that he was shot in the spine, reportedly after the vehicle in which he was traveling failed to stop at a checkpoint and then rolled over. There have also been widespread allegations that Shaban was tortured whilst in custody, although this is vehemently denied by Bani Walid leaders who say that he was treated in hospital and visited by the Red Cross.

Today, a Red Cross spokeswoman currently visiting Bani Walid to distribute humanitarian supplies refused to offer any comment on whether evidence of torture against Shaban had been found or not.

Nevertheless, Shaban’s death prompted a resolution [Law no.7] from the National Congress giving Bani Walid ten days to surrender those suspected of involvement in the case and authorising the ministries of defence and interior to use force if the town did not comply.

That deadline was subsequently pushed back to 10 October, today, following a request by Magarief to allow more time for negotiations. Libya’s military commanders have said that should the deadline pass without a resolution then an attack remains a possibility.

“After the passing of the deadline today, General Mangoush will make a decision on whether or not to attack following consultations with political leaders and his field commanders”, Colonel Sheikhi said.

The likelihood of the suspects being handed over before midnight is virtually non-existent, however, since leaders in Bani Walid say that no investigation to try and find the suspects has even begun.

“We do not know who the suspects are”, said Mohammed Barguti, the head of Bani Walid’s de facto ruling council. “Law no.7 is wrong and puts us in an impossible position. Before this law was passed, nobody came here to investigate what was really going on. All these decisions have been taken by people far away and that is unacceptable”.

Barguti said that he would have no objections to police coming from outside Bani Walid to investigate the incident, but said that no such offer had been made.

“The problem is that the state is still very weak”, he said. “There is no proper judiciary and no proper police. We have said to Magarief that Bani Walid is under the authority of Libya and accepts the new system. However, there is nothing we can do until all the government institutions are working properly”.

Barguti said that if there was an attack on Bani Walid it would come from Misrata, not on the orders of the government. “The government is trying to find a peaceful resolution. They are trying to stop Law no.7, which is why they are having to negotiate with Misrata as well as us.”

Another leader on the council, Muftar Abduljabar, insisted that the case was fundamentally a judicial matter, not a military one, and that any attack on Bani Walid should be considered illegal.

“Law no.7 is ludicrious. It is the judiciary, not the Congress, who should be responsible for such matters. There are perhaps 200 prisoners from Bani Walid being held in Misrata, but nobody is threatening to go to war over them”.

Local residents have said they are ready to fight if attacked, but remain hopeful that a peaceful resolution can be achieved. Following a lengthy blockade of some ten days, supplies began trickling back into the town yesterday along the Tarhuna road, including food, fuel and some medical supplies from private donors.

“Bani Walid does not want to fight with anybody”, said Ahmed Almaried, a local businessman. “It just wants to be left in peace”.

The trial of Qaddafi’s former spy-chief was started – and postponed – for the third successive time yesterday, with the hearing now set to resume on 28th August.

The case was further complicated when the lawyer for the defence failed to appear in court owing to the fact that he was standing as a candidate for the elections.

With replacements having been appointed, the defence team promptly requested the adjournment to allow them sufficient time to review the case against their client, Abu Zaid Dorda, which runs to more than 3,000 pages.

Dorda, who served as the old regime’s last head of intelligence, is standing trial on charges of incitement to murder, providing arms for the purpose of killing civilians, conspiring to provoke civil war, denying people their right to protest, unlawful detention and abuse of authority.

The public prosecution team argued that the request for a further postponement should be dismissed, saying that the defence had by now had more than enough time to prepare for the case, which originally started on 5 June.

The prosecution also took the opportunity to submit additional evidence before the court, including statements from a witness who worked as the director of Dorda’s office during last year’s revolution.

The evidence included allegations that Dorda armed members of his tribe to fight against Zintan, as well as information from the case against fellow regime member Baghdadi Al-Mahmoudi, in which Dorda was reported to have worked with Abdullah Al-Senussi during the Tunisian revolution to prevent a similar uprising from taking place in Libya.

Audio recordings of phone calls between Dorda and Qaddafi’s former foreign minister, Musa Kusa, were also provided, which the defence argued provided further evidence of Dorda’s involvement in the suppression of the revolution and giving orders against revolutionaries.

In addition to denying the charges against him, Dorda also claimed he had been denied the right to meet privately with a lawyer and had undergone improper interrogations during his 10 months in detention.

“I am sometimes interrogated for more than seven hours at a time”, he said, “by people not from the prosecutor’s office, and I am moved from jail to jail during the process”.

Two other attorneys also submitted files against Dorda to be added to the case, both of which pertained to further claims by individuals which, the defence argued, substantiated the charges against him.

The judge accepted the files and announced the postponement of the trial.

Fighters in the western mountain town of Zintan have refused to give up Saif al-Islam, the most prominent son of slain ruler Muammar Gaddafi, saying his secrets are too important to risk.

On Sunday, Zintanis detained an International Criminal Court lawyer who was visiting Saif al-Islam for allegedly trying to deliver letters to him. They say the letters, which she hid in her clothing, posed a danger to Libya’s national security.

Zintan’s leaders say their people sacrificed many lives for the revolution that ended Gaddafi’s rule, and that Saif al-Islam has information that could implicate Libya’s interim leaders and foreign countries in wrong doing.

Libya was supposed to be different. The lessons of Iraq and Afghanistan had been learned, David Cameron and Nicolas Sarkozy insisted last year. This would be a real humanitarian intervention. Unlike Iraq, there would be no boots on the ground. Unlike in Afghanistan, Nato air power would be used to support a fight for freedom and prevent a massacre. Unlike the Kosovo campaign, there would be no indiscriminate cluster bombs: only precision weapons would be used. This would be a war to save civilian lives.

Seven months on from Muammar Gaddafi’s murder in the ruins of Sirte, the fruits of liberal intervention in Libya are now cruelly clear, and documented by the UN and human rights groups: 8,000 prisoners held without trial, rampant torture and routine deaths in detention, the ethnic cleansing of Tawerga, a town of 30,000 mainly black Libyans (already in the frame as a crime against humanity) and continuing violent persecution of sub-Saharan Africans across the country.

A year after the western powers tried to make up for lost ground in the Arab uprisings by tipping the balance of the Benghazi-led revolt, Libya is in the lawless grip of rival warlords and armed conflict between militias, as the western-installed National Transitional Council (NTC) passes Gaddafi-style laws clamping down on freedom of speech, gives legal immunity to former rebels and disqualifies election candidates critical of the new order. These are the political forces Nato played the decisive role in bringing to power.

Now the evidence is starting to build up of what Nato’s laser-guided bombing campaign actually meant on the ground. The New York-based Human Rights Watch this week released a report into the deaths of at least 72 Libyan civilians, a third of them children, killed in eight separate bombing raids (seven on non-military targets) – and denounced Nato for still refusing to investigate or even acknowledge civilian deaths that were always denied at the time.

Given the tens of thousands of civilians killed by US, British and other Nato forces both from the air and on the ground in Iraq, Afghanistan, Pakistan and Yemen over the last decade, perhaps Nato commanders prefer not to detain themselves with such comparative trifles. And Human Rights Watch believes that, whatever the real number of civilians directly killed by Nato bombing, it was relatively low given the 10,000-odd sorties flown.

But while Nato’s UN mandate was to protect civilians, the alliance in practice turned that mission on its head. Throwing its weight behind one side in a civil war to oust Gaddafi’s regime, it became the air force for the rebel militias on the ground. So while the death toll was perhaps between 1,000 and 2,000 when Nato intervened in March, by October it was estimated by the NTC to be 30,000 – including thousands of civilians.

We can’t of course know what would have happened without Nato’s bombing campaign, even if there is no evidence that Gaddafi had either the intention or capability to carry out a massacre in Benghazi. But we do know that Nato provided decisive air cover for the rebels as they matched Gaddafi’s forces, carried out massacres of their own and indiscriminately shelled civilian areas with devastating results – such as reduced much of Sirte to rubble last October.

There were also Nato and Qatari boots on the ground, including British special forces, co-ordinating rebel operations. So Nato certainly shared responsibility for the deaths of many more civilian than its missiles directly incinerated.

That is the kind of indirect culpability that led to the conviction last month of Charles Taylor, the former president of Liberia, in the UN-backed special court for Sierra Leone in The Hague. Taylor, now awaiting sentence and expected to be jailed in Britain, was found guilty of “aiding and abetting” war crimes and crimes against humanity during Sierra Leone’s civil war in the 1990s. But he was cleared of directly ordering atrocities carried out by Sierra Leonean rebels.

Which pretty well describes the role played by Nato in Libya last year. International lawyers say legal culpability would depend on the degree of assistance and knowledge of war crimes for which Nato provided cover, even if the political and moral responsibility could not be clearer.

But there is of course simply no question of Nato leaders being held to legal account for the Libyan carnage, any more than they have been for far more direct crimes carried out in Iraq and Afghanistan. The only Briton convicted of a war crime over the bloodbath of Iraq has been Corporal Donald Payne, for abuse of prisoners in Basra in 2003. While George Bush has boasted of authorising the international crime of torture and faced not so much as a caution.

Which only underlines that what is called international law simply doesn’t apply to the big powers or their political leaders. In the 10 years of its existence, the International criminal court has indicted 28 people from seven countries for war crimes and crimes against humanity. Every single one of them is African – even though ICC signatories include war-wracked states such as Colombia and Afghanistan.

That’s rather as if the criminal law in Britain only applied to people earning the minimum wage and living in Cornwall. But so long as international law is only used against small or weak states in the developing world, it won’t be a system of international justice, but an instrument of power politics and imperial enforcement.

Just as the urgent lesson of Libya – for the rest of the Arab world and beyond – is that however it is dressed up, foreign military intervention isn’t a short cut to freedom. And far from saving lives, again and again it has escalated slaughter.

On the insurrection in Zawiya (a town in western Libya): During the three weeks [that the town was controlled by the rebels], all public buildings were pillaged and set on fire. . . .

Everywhere, there was destruction and pillaging (of arms, money, archives). There was no trace of combat, which confirms the testimony of the police [who claim to have received orders not to intervene]. . . .

There were also atrocities committed (women who were raped, and some police officers who were killed), as well as civilian victims during these three weeks. . . .

The victims were killed in the manner of the Algerian GIA [Armed Islamic Group]: throats cut, eyes gauged out, arms and legs cut off, sometimes the bodies were burned . . .

REBEL: She told us “Please this is not our ways or what our faith or our Islam condones. Please why are you doing this?”

REPORTER: And you didnt listen to her?

REBEL: No.

REPORTER: Because you have no heart or feelings to listen to her, your conscience is dead. I will let the Libyan people watching analyze and try to understand this because I cant understand it or make sense of it. So you cut her breasts off?

REBEL: Yes, and her daughter fainted and we went back for the rest of the children.

REPORTER: And you went out to celebrate?

REBEL:Yes.

REPORTER:Tell me about the celebration, how did you celebrate?

REBEL: We put breasts on a table and we were chanting and saying God is Great.

REPORTER: You can even say God’s name? How can you know God?..Ok what table? Tell me about it.

REBEL: We got a table and and displayed breasts we cut off from the girls and women.

REPORTER: Tell me more about this celebration..what else did you do?

REBEL: We were drinking alcoholic drinks and had the radio on.

REPORTER: So you were happy?

REBEL: Yes we even had drinks and pastries and desserts.

REPORTER: You had food and drinks and pastries laid out? Dear God. Tell me do you believe in God? Even though I don’t think you have any idea about him. You know if you weren’t sitting here right in front of me and I am hearing this from you, your confessions, I wouldn’t believe it because I don’t think any human being can commit such ugliness such as slaughtering, beheading, raping and then mutilating and cutting off the raped women’s breasts and then celebrate and dance and have cake afterwards. There is no category in the human race for such an example as the one sitting in front of me now.

Alexandra I would like to post that cable here. It’s clear you hit on something critical when you discovered this info on AECOM. In essense AECOM bribed Libya for over 2B in contracts in exchange for a more favorable political relationship with the US.

1.(C) Summary: U.S. companies AECOM and the Tennessee Overseas Construction Company (TOCC) inked separate deals worth a total of $2.0 to $3.0 billion with Libya’s Housing and Infrastructure Board. AECOM is to provide project management for all infrastructure development under the HIB’s auspices, and has committed to an ambitious U.S.-based training program for HIB executives and engineers. TOCC’s agreement obliges the company to undertake high-profile infrastructure construction and refurbishment projects in Tripoli and Benghazi; the company envisages bringing up to 130 American employees to Libya in the coming year to help manage its projects. The GOL apparently awarded the contracts to U.S. firms for at least partly political purposes, telling company representatives that the deals symbolize the fact that U.S.-Libyan ties have moved beyond strictly security (i.e., WMD and counter-terrorism) concerns. The agreements underscore that the GOL continues to directly link commercial contracts to political relationships. The potential return to Libya of large numbers of non-official Americans has positive potential for people-to-people and cultural exchange, but could further anger Islamic militants already troubled by U.S.-Libyan reengagement.

AECOM TO MANAGE ALL INFRASTRUCTURE PROJECTS

2.(U) After nearly two months of negotiations, Houston-based company AECOM signed a mega-contract December 13 with Libya’s Housing and Infrastructure Board (HIB) to provide project management services. The contract guarantees two years of work for AECOM for $201 million, and provides for three additional option years for a potential total contract value of $574 million. AECOM is to lead the HIB’s 250-member Program Management Department in its administering of all projects that fall within the GOL’s $50 billion comprehensive housing and infrastructure development program, to include contracts with any third-country companies. The scope of the development program includes urban design and development, housing unit construction, road construction and upgrades, and development of wastewater management systems.

FOCUS ON TRAINING, HUMAN CAPACITY BUILDING

3.(C) Reflecting the GOL’s continuing focus on capacity-building, the contract obliges AECOM to train over 100 HIB executives, engineers and technical specialists in project management at AECOM’s Houston headquarters during the coming calendar year. Dr. Ibrahim Shukhri, head of HIB’s Program Management Department, told P/E Chief December 16 that three senior HIB officials have already applied in Tunis for J-1 visas to undertake a year-long program management course in Houston. Additional tranches of HIB engineers — currently envisaged as cohorts of 50, 25 and 25 — are scheduled to undergo three month training courses in Houston beginning in March/April next year. Jim Thompson, President of AECOM subsidiary Turner Collie & Braden and AECOM’s signatory on the contract, told P/E Chief December 13 that AECOM plans to send up to 30 American employees to Libya in the first half of 2008 to help manage a bevy of recently concluded housing and infrastructure contracts (reftel and previous).

TOCC WINS MEGA-CONTRACT FOR HOUSING, INFRASTRUCTURE PROJECTS

4.(U) Separately, the Tennessee Oveseas Construction Company (TOCC), in partnership with Washington Group International, signed a LD 1.5 billion (about $1.2 billion) agreement with the HIB December 16.(Note: It is believed that the agreement represents the largest single non-oil and gas deal for a U.S. company in Libya to date. End note.) The deal was concluded in a televised meeting of the HIB at which a total of over LD 6.85 billion (about $5.3 billion) worth of infrastructure contracts with companies from India, China, Korea, Turkey, Russia and Tunisia were signed. TOCC’s agreement obliges the company to undertake high-profile infrastructure construction and refurbishment projects in Tripoli and Benghazi, to include housing units, roads and wastewater management. The contract represents a framework agreement; individual contracts for specific projects envisaged in the framework agreement are to be negotiated separately. The agreement guarantees $1.2 billion TRIPOLI 00001053 002.2 OF 003 worth of work, but TOCC’s local office director, Selim Edes, told P/E Chief that it could be expanded to include a rainwater collection project in Benghazi, which could bring the total contract value to between $2.5 and $3.0 billion.

LARGE NUMBERS OF AMERICANS TO RETURN TO LIBYA?

5.(C) TOCC Finance Director Jennifer Windus (protect), who signed for the company, told the Charge that the company plans to send 50 American employees, up to a third of whom may come with families (about 15-20 children), to Libya in the next five months. TOCC envisages a total American employee presence of 100 within the coming calendar year, with a possible 30 additional employees in Benghazi if the rainwater collection project comes to fruition. She noted that obtaining Libyan visas and securing appropriate housing could significantly slow the dispatch of those employees. TOCC’s Tripoli office currently comprises 15 locally-engaged staff.

AECOM, TOCC BENEFIT FROM GOL’S DESIRE TO SEND POLITICAL SIGNAL

6.(C) Windus told the Charge that Dorda and other HIB officials had stressed that they wanted to award the contract to a U.S. company as “a symbol” of the fact that the bilateral relationship had moved beyond strictly security (i.e., WMD and counter-terrorism) concerns. The fact that TOCC was a U.S. company was “critical” from the HIB’s perspective. Windus telephoned P/E Chief later in the day seeking an Embassy quote for the company’s press release; she said Dorda had counseled her to solicit remarks emphasizing the political, vice commercial, significance of the contract. (Note: Post’s anodyne language welcomed news of the contract as a sign of the continuing development of U.S.-Libyan ties. End note.) Dorda reportedly underscored that the Charge’s attendance at the contract signing was “an important symbol of the new relationship”.

7.(C) Separately, AECOM’s Jim Thompson (protect) shared with P/E Chief December 13 his impression that being an American company had been “extremely important” to securing the contract. He conceded that unnamed European firms had submitted bids that were in some respects more competitive, but the HIB’s desire to “buy American” — in part for purposes of political symbolism — carried the day for AECOM.

HIB SEEKS GREATER U.S. COMPANY PARTICIPATION IN LIBYA’S INFRASTRUCTURE RENAISSANCE

8.(C) In a meeting with the Charge before the signing ceremony, HIB Chairman Abuzaid Dorda sounded a similar refrain, saying more U.S. companies should “focus on the future” and bid for lucrative GOL development contracts. Noting that some U.S. and European companies remain “hesitant” about doing business in Libya because of past contretemps, he reiterated the GOL’s desire for greater participation by U.S. companies in large-scale infrastructure and development projects. Stressing the American angle, he noted that AECOM enjoyed the HIB’s “full confidence” and said the HIB would sign a contract worth “hundreds of millions of dollars” (NFI) with U.S. company KBR on December 30 for infrastructure projects in Benghazi.

PUBLIC COMMITMENT TO ANTI-CORRUPTION …

9.(U) In a subsequent televised meeting of the HIB that resembled nothing so much as a game show, Dorda continued sounding the American theme. TOCC’s was the first contract signed on-air; Dr. Shukhri told P/E Chief that the decision had been deliberately designed to “emphasize American participation in the Jamahurriya’s development”. AECOM’s deal also featured prominently in Dorda’s remarks, even though the deal was signed several days earlier and no one from the company was present. In a somewhat bizarre lecture clearly crafted to appeal to viewers at home, Dorda chided winners to take seriously the transparency and anti-corruption clauses of their respective contracts. Noting that he had personally blacklisted three foreign companies for unspecified alleged acts of corruption in recent months (NFI), he cautioned contract winners that the GOL has “our methods” for “knowing what you are up to”.

10.(C) Companies accused of paying bribes or engaging in other forms of graft would be assumed to be guilty unless able to prove otherwise, would be forced to forfeit their contracts and pay penalties, and would be summarily ejected from the country TRIPOLI 00001053 003.2 OF 003 and not allowed to bid on future GOL contracts. In a seeming contradiction with the “guilty until proven innocent” assumption, Dorda claimed there was “no excuse” for companies not to immediately report solicitations of bribes to the HIB. Once they had done so, it would “be the HIB’s problem” to deal with.

11.(C) On the margins of the televised meeting, Brown & Root country director Richard Weeks (protect) told P/E Chief that the HIB delayed providing a copy of its putative Benghazi contract, and only did so on the morning of December 16. Seeking to inflate the figure for the total value of contracts concluded on the day, the HIB pressured KBR to sign the contract without having adequately reviewed it. Weeks said HIB officials took back the sole hard copy they’d been given when they determined that KBR would not sign without having their attorneys perform necessary due diligence. In a last-minute plea to Brown & Root, P/E Chief overheard an HIB official telling Weeks not to worry about the details of the contract because the contract itself was “meaningless”. “What is important is that we trust you”, the official said. Conceding that the remark confirmed the worst suspicions of some KBR executives about the GOL’s approach to the sanctity of contracts, Weeks said he was wrestling with whether share it with his corporate management.

12.(C) Comment: While certainly good news for American business, AECOM and TOCC’s wins underscore that the GOL, encouraged by its interactions with the French and Italians, continues to view commercial contracts as means by which to curry political favor. The new deals also represent a potentially significant evolution in the U.S. business presence in Libya. To date, U.S. companies — with the notable exception of oil and gas concerns — have largely focused on selling discrete products and services, a relatively straightforward exercise. Participation in performance-based contracts represents a markedly more complicated exercise in which the potential exposure to graft, delayed payment and breach of faith are greater. The potential return to Libya of non-official Americans in numbers not seen since the early 1970′s also represents a mixed blessing. The people-to-people and cultural exchange potential are great and will likely be welcomed by many Libyans; however, increased numbers of Americans could constitute a further irritant to (and target for) Islamic militants already leery of U.S.-Libyan reengagement. Lizzie Cocker: ‘ICC tool of Western imperialism’

The International Criminal Court (ICC) is a puppet institution which serves the imperialistic interests of the Western powers, a political observer says.
“The ICC is a tool of Western imperialism … What it is doing is very clear and that is continuing the US and Europe’s imperialistic character,” Lizzie Cocker told Press TV. The political observer was elaborating on the ICC’s recent decision to formally issue arrest warrants for Libyan ruler Muammar Gaddafi, his son Seif al-Islam and the regime’s spy chief Abdullah al-Senussi.

However, senior officials in Tripoli have denounced the ICC action, saying the court is a Western creation for prosecuting African leaders. Since the revolution against Gaddafi’s regime began in mid-February, tens of thousands have been killed and injured in clashes between Libyan revolutionaries and pro-Gaddafi forces.

“The ICC has no power to enforce its powers because it is not recognized widely across the world including by half the African continent and by the US itself for different reasons,” Cocker said. She pointed to the fact that the main agenda of ICC, since its creation seven years ago, has been focusing on African countries, and the recent case against Libya is a part of that plan. Cocker criticized the court for turning a blind eye on other cases of human rights violations in other parts of the world, including Israel’s crimes against the Palestinian population.

Former rebels who helped to topple Libya’s late dictator Moamer Kadhafi and a human rights lawyer whose arrest sparked the uprising were handed key posts in a new government unveiled on Tuesday.

Interim prime minister Abdel Rahim al-Kib announced the new cabinet line-up at a news conference just a month after the capture and lynching of Kadhafi who ruled the country with an iron-fist for 42 years.

“I can reassure everyone: all of Libya is (represented) in the new government,” Kib told reporters of the line-up which had originally been due to be announced on Sunday.

The delay in its unveiling was apparently caused by the arrest on Saturday of Seif al-Islam Kadhafi, the prominent son and onetime heir-apparent of the slain dictator.

Osama Juili, commander of the Zintan fighters who arrested Seif, got the defence ministry, while the interior ministry went to Fawzi Abdelali from the former rebel town of Misrata, whose fighters captured Kadhafi in October.

Kib chose Ashur bin Khayyal, Libya’s envoy to Canada under the Kadhafi regime who joined the opposition in the 1990s, to head the foreign ministry, while Abdelrahman bin Yazza — a former official at Italy’s energy major ENI — becomes interim oil and gas minister.

Lawyer Fethi Tarbel, whose brief arrest on February 15 was the spark that lit the popular uprising against Kadhafi’s regime in the eastern city of Benghazi, was named minister of youth and sport.

Kib will head a 24-member government which will include such portfolios as the ministry of martyrs, wounded and missing people, and a ministry of civilian society.

The National Transitional Council gave the new government its vote of confidence, NTC vice chairman and official spokesman Abdel Hafiz Ghoga said.

The NTC, whose rebel fighters backed by NATO air support toppled Kadhafi in October, chose Kib, a little-known university professor from Tripoli, on October 31 to form an interim government.

Having declared the country’s “liberation” three days after the October 20 capture and killing of Kadhafi, the NTC has launched a roadmap to a new Libya with a 20-month countdown to a general election.

Under the roadmap, the NTC is to hand over power to a 200-member elected assembly within eight months which in turn has two months to name a premier whose government must form a commission to draw up a constitution.

The NTC published its roadmap in August and is due to step down once the congress holds its first session.

Kib had said the new government would be formed of technocrats, although he came under pressure from Libya’s tribes and numerous armed factions which had also demanded a role.

An NTC statement distributed after Kib unveiled his government spelled out the tasks expected to be accomplished by the cabinet, with the “restoration of normal life.”

“This provisional government aims to achieve the following: first security, stability and restoration of normal life by providing basic social services, the return of children to their schools and the payment of (overdue) salaries,” it said.

It also pledged to establish “justice which guarantees the rights of individuals who have been harmed over the past 42 years and also which guarantees those accused a fair trial.”

The new government, the statement said, will help efforts by the NTC “to achieve national reconciliation” in Libya.

It will also strive to rebuild the army and the security forces and promote “the integration of interested citizens into these institutions.”

Hours before Kib’s news conference, the Zintan military council whose fighters captured Seif al-Islam issued a statement denying that the defence ministry would be given to Juili as a bribe because his men allegedly refused to hand over Kadhafi’s son to the NTC.

“The Zintan military council denies the information published by media according to which Zintan is involved in blackmail regarding Seif al-Islam in return for a cabinet post,” a statement said.

It said Seif was being held in Zintan “for security reasons in agreement with the National Transitional Council.”

In Geneva, the International Committee of the Red Cross said two of its representatives met Seif on Tuesday for several hours in Zintan.

“He appeared to be in good health,” spokesman Steven Anderson told AFP, adding: “The organisation’s findings are being shared with the detaining authorities only.”

Advice to Libyan Negotiators

I have what I consider to be crucial advice. I believe that the relevant members of the Jamahiriya that will be in negotiation with France, or whatever, should FIRST consult with Dr. Webster Tarpley. THIS man has proven himself to be almost a SEER!! He is obviously a revolutionary leftest–about as far left as they come.

He is EASILY the most highly-educated Western man on earth. He knows the tricks of the West. He should be consulted before negotiations begin, and he should actually be at the negotiations as an advisor.

The Jamahiriya must be extremely careful to NOT fall to the disaster capitalism model that the West, particularly the United States, has been using to seize economic control of nations. This is what they hope to do now. They are hoping that you will use their IMF to help “restructure” Libyan society, and to help re-build Libya.

The Jamahiriya should ask friendly countries that have proven themselves to be friends of Libya; lovers of Libya. There should be NO RUSH to re-build!! This is a mistake that African nations made in the past: trying to quickly modernize.

Do not fall into the trick of accepting IMF loans. They will ask you to PRIVATIZE everything. They will ask you to DEPRESS WAGES. They will ask you to re-arrange your economic system and replace it with THEIRS.

Here is my view: They must now suffer TOTAL DEFEAT. They should have NOTHING to do with the rebuilding of Libya. There are friendly nations, such as Venezuella and South Africa, that can help, no matter how little.

I am certain that Gaddafi was smart enough to store some of Libya’s money in safe places that the West cannot touch.

As regards the re-building of Libya, remember my early suggestion, months ago: That Libya invited thousands of people from all over the world to come and help re-build.

The IPCO should facilitate the organising of that as there are several advanced ideas already submitted.

So, the Libyan government should be confident that it can search for, and identify, FRIENDLY architects, builders of all type, carpenters, etc., that will help–maybe even for free, who knows.

This is a time that Libya can show the entire world HOW TO REMAIN FREE.

There is an old saying in the U.S.: “Hit a man while he’s low.” Like, when you’re in a fist fight. And you get the best of the guy, and he’s down on one knee, trying to get up. Well THAT is when you really BEAT THE SHIT OUT OF HIM!

And that is what the northern countries are going to try to do NOW. They figure that Libya is LOW; that, because of that, Libya will HAVE to accept terms placed upon it by France and all them other DEVILS.

But, remember the story of the turtle and the hare. Libya can now take its time. If the French want to help [though I'm not sure I'd trust this], let them clear out those Al-Qaeda members and those Columbian mercenaries.

They should also pay REPARATIONS, with no strings attached. They too should contribute to the rebuilding of Libya. But they must not be allowed to force Libya to live in THEIR economic world, which is CRUMBLING (lest we all forget).

Dr. Webster Tarpley MUST be contacted, and he MUST be asked for advice before going into negotiations with the devil. That is merely my opinion. Another person you might want to get advice from is Naomi Klein, who wrote the book, The Shock Doctrine: The Rise of Disaster Capitalism.

Dr. Tarpley and Ms. Klein are white people. They know the bullshit that their people can put down. They can’t be fooled.
